Terms of Use

Last updated:

These Terms of Use govern access to shouldersvital.world and the purchase and participation in healthy back in the office programmes provided by SpineShift, a service brand of Shouldersvital. By using our website or booking a programme, you agree to these terms.

1. Definitions

In these Terms, "we," "us," and "our" refer to Shouldersvital operating as SpineShift. "You" and "your" refer to the individual visitor, booker, or participant. "Programmes" means our structured workplace wellness offerings including Desk Posture Foundations, Team Flex Hour Programme, and SpineShift Enterprise Rollout. "Content" means text, graphics, session materials, and digital resources we provide.

2. Website Use

You may browse shouldersvital.world for lawful purposes related to evaluating or booking office back health services. You must not attempt unauthorised access to our systems, scrape content for commercial republication without permission, introduce malware, or use the site in any way that could harm SpineShift, other users, or third parties.

3. Information Accuracy

We strive to ensure programme descriptions, pricing in GBP, and scheduling information on the website are accurate. Prices and availability may change; confirmed bookings are governed by the price stated in your written confirmation. Content is for general workplace education and is not a substitute for personalised professional advice where your circumstances require it.

4. Bookings and Contracts

An enquiry through our contact form does not constitute a binding contract. A booking is confirmed when we issue written acceptance (email) specifying programme, date, fee, and delivery terms. Corporate clients may be subject to additional master service terms signed separately. The individual or organisation named in the booking is responsible for payment unless otherwise agreed in writing.

5. Participant Responsibilities

Participants must follow facilitator instructions, disclose relevant physical limitations before sessions, wear suitable clothing for gentle movement, and behave respectfully toward staff and colleagues. You are responsible for ensuring your workspace is safe for brief movement activities. We reserve the right to pause or end a session if safety or conduct concerns arise.

6. Employer-Sponsored Programmes

Where your employer commissions SpineShift programmes, your employer may set additional attendance rules. Survey data sharing with your employer follows our Privacy Policy and the consent options presented at survey time. Shouldersvital is not responsible for internal HR decisions made using aggregated programme feedback.

7. Intellectual Property

All Content, branding, session plans, and materials are owned by or licensed to Shouldersvital. You receive a limited, non-transferable licence to use materials for internal workplace wellness purposes within your organisation. You may not resell, publicly distribute, or modify materials for commercial use without our prior written consent.

8. Virtual Delivery

Virtual sessions require a stable internet connection and compatible video software. We are not liable for disruptions caused by your IT environment. Recordings of live sessions are not provided unless explicitly agreed in writing for enterprise clients with appropriate participant notices.

9. Limitation of Liability

Our programmes promote general movement awareness and ergonomic habits for office workers. To the fullest extent permitted by law, we exclude liability for indirect or consequential loss. Our total liability arising from any booking shall not exceed the fees paid for that specific programme. Nothing in these Terms excludes liability for death or personal injury caused by negligence, fraud, or other liability that cannot be excluded under UK law.

10. Indemnity

You agree to indemnify Shouldersvital against claims arising from your misuse of the website, breach of these Terms, or provision of inaccurate booking information, except where caused by our negligence or wilful misconduct.

11. Third-Party Links

Our website may link to third-party resources such as mapping services. We do not control and are not responsible for external sites. Access is at your own risk subject to their terms.

12. Force Majeure

We are not liable for failure or delay caused by events beyond reasonable control, including severe weather, transport disruption, pandemic restrictions, or failure of third-party platforms. We will work with you to reschedule affected sessions where possible under our Return Policy.

13. Governing Law and Jurisdiction

These Terms are governed by the laws of England and Wales. Disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales, without prejudice to mandatory consumer rights if you qualify as a consumer under UK law.

14. Changes

We may revise these Terms. The updated version will be posted on this page with a revised date. Continued use of the website after changes constitutes acceptance for browsing purposes; existing bookings remain subject to the terms in effect at confirmation unless otherwise agreed.
